This paper presents the ownership right to real estate evolution in Poland, methodical aspects of its establishing and the way of the legal status regarding the real estates registration in consideration of its relations with cadastre. The re-searches on the establishing of the legal status regarding the real estates which are purchasing to the benefit of the State Treasure based on the real estates in Wróblówka, Stare Bystre, Rogoźnik and Ludźmierz villages in Nowy Targ district. That real estates are subjected on the article 73 of the Act from 1998 year. ...
Model of ground cadastre in Poland was taken under analysis in this paper. Roles and graphical notation of Object Oriented Analysis was used to model ground cadastre. That model consists of four layers of different abstraction: sub-jects, objects and classes, structures, attributes. Additionally model includes sub-jects: organization, geometry, objects, entity, law state. Ground cadastre was pre-sented as multitasking system. Such defined system is possible to be introduced in Polish conditions.

Precise analysis of agricultural structure gives among others possibility of rational spatial planning, monitoring of the management of a local government's property and supporting of the acquisition of structural funds from EU.The aim of the paper is to show course and directions of changes of agri-cultural structure. Suitable analysis of cadastral data allowed to point at areas of the biggest priority of performing improvement of agricultural. Reasonable plan-ning of arrangement - agricultural works, that is indication of priority areas for this kind of processes from the level of region is only possible in case of consistent and synchronized spatial databases, for which cadastre is the basis of information. The area of interest is Małopolskie region. ...
The land consolidation is a several scheduled organizational and technical activities taked into consideration the conditionings: natural, economic, legal and social, for adjusting space structure for requirement of rational usage rural areas. Otherwise the main aim of land consolidations is improvement life conditions as well as work conditions of village people taking into account areas protection where they works. Environment protection is important factor or necessity in view of the areas where there are no interfere into nature are still decrease. Above 90% of Poland are rural areas so existing economy has influencing for nature in such terrain. Because this areas are decreasing and without it it's difficult to live for the human and another human being it's very important to protect this areas via carrying activities, among others through land consolidations which will not suc-ceed of the all ecosystem's elements. Functioning of the people on rural areas is tightly connected to transform of that space towards one's own needs, thru rational management. But reasonable housekeeping it is correct location of rural areas which is difficult to achieve without properly infrastructure designed. This infra-structure enable moving - through roads, allow to lead proper water economy - drainage ditches and also ...
In recent years we have anxiously been observing climate instability - sudden temperature changes, warm winters, torrential storms, hurricanes and heavy rains. These phenomena exert a negative impact on the environment and human safety. Information on the environment and knowledge of its components, particularly the surface of the earth, fossil resources, water, air, landscape, climate and the other elements of biodiversity as well as the common interrelations between these elements, will allow for predicting spatial changes. Efficient monitoring that uses a system of spatial information, including the cadastral database, constitutes the basis for effective prevention of potential damages and minimization of losses due to natural disasters. ...
Cartographic elaboration that provide information about landscape changes are analysed in the article. The purpose of this article is to present the development of cartographic materials that provide information about landscape. At the outset illustrates the distribution of sources information about the landscape whereas the time period for which these resources apply. The following materials were analysed: Polish land register, topographic maps, master map, cadastral map, orthophotomaps, local spatial plan, and study of conditions and directions of spatial development. The article focuses on presenting the development of cartographic sources from Polish territory. The chart made on the basis of analysis shows periods in which each source occurred. Nowadays, modern technologies are used for establishing, maintaining, updating and sharing information on land. In order to properly present landscape changes both the old and new sources of information should be taken into account, also a constant modernization sources should be performed. ...
Land and buildings registry, according to the current rules in Poland, acts as a real estate cadastre. As a public register, is subjected to the current and periodic modernization. The aim of the modernization is to improve the quality of the collected data. The most satisfactory results in the process of modernization are obtained on the basis of geodetic field measurements. Photogrammetric measurements are a more economical solution, but their use carries a risk of failure in meeting the criteria of accuracy positions of border points. This paper represents a case study on the effects of the process of modernization of the land and building registry for areas where the source material are registry maps in the scale of 1: 2000, created on the basis of photomaps, or cadastral maps in the scale of 1: 2880. The aim of the study is to assess and verify the suitability of these materials in the process of modernization. The study was conducted for 30 registration precincts, located in the Małopolskie Voivodship. For the analyzed objects the following information was collected: the total number of parcels within the precinct and the number of parcels that meet one of the five criteria of ...
This study will analyze the amendments to the legal provisions which refer to the entering of building structures into the real estate cadastre, contained in the Regulation on the register of land and buildings, introduced during the subsequent amendments, that is in 2013 and in 2015, with respect to the original text of 2001. This will form the background for the issue of a partial loss of the updated status of the database for the building records therein entered under the previous wording of the Regulation on the register of land and buildings, becoming effective as of the day the next amendment to the Regulation comes into force. The effects of these amendments will be analyzed, some of which should be considered positive, as the new provisions clarified the previous formulations, which remained unclear and gave rise to ambiguous interpretation of cadastral data of buildings. However, another part of the amended provisions makes the essential cadastral data of the buildings which are entered into the real estate cadastre outdated, despite no changes made in their construction. These essential data include, for example, status of the building or contour of the building, and the resulting built-up area. ...
The modernization of the cadastre is such a complicated and complex process that may cause many significant results. Cadastral parcel surface areas changes and changes in land use are the most important of them. These factors have also a direct influence on the real estate tax base assessment.Using materials obtained from geodetic and cartographic documentation centres, the analysis concerning the considered problem has been performed. The basic facts connected with the cadastre modernization and legal rules concerning the real estate, agricultural and forestry tax bases determination have been analysed too. It has been proved, that changes in spatial data which have arisen during the modernization of the cadastre, especially in the scope of land use, may have an essential significance for taxpayer. Performed analysis denote, that comprehensive cadastre modernization from proper Municipal and Communal Offices' point of view which are real estate tax collectors, is financially profitable enterprise. ...
The article constitutes the part of broader studies on the issue of practical usefulness of public registers, comprising the databases on real property, in tasks related to real estate appraisal. It includes the results of research on the scope in which geodetic public registers (Land and buildings register as well as the Register of Prices and Values of Real estate) collect essential or only useful data to the process of land property appraisal. Presented analyses are demonstrated on the examples of above-mentioned registers, conducted in the offices of the district authorities in Lublin Voivodeship. The results of prepared analyses are critical. The researched public registers, operating in the current condition, do not have formal possibilities of collecting the range of essential information on properties. The studies showed that even though architects of databases, implemented in the departments of geodesy in some offices of district authorities, anticipated the possibility of registering specific useful data, nevertheless in practice appropriate fields of relevant registers remain unused. ...
The article presents the size of the land being in checkerboard of land in the villages of the municipality Sławno, located in central Poland, Lodz province. The analysis included the surface, the number of parcels and the number of owners. The study was performed by checkerboard array capable of identifying the prevalence of land by non-residents and local residents. Such an approach allows the determination of the exchange of land between them and their liquidation in the process of land consolidation works. The genesis of the phenomenon checkerboard of land is closely linked to historical facts. As a result of the acquisition method of recording the factual and legal land from invaders countries, in the late nineteenth century, in the cadastre Polish notes to this day many inaccuracies. Some of them are the result of differences in the definitions of cadastral objects under Austrian rule, Prussian and Russian and specific rights of inheritance of land. Polish territory is variation in the severity and the shape and dimensions of the checkerboard land. So we can say that examined the phenomenon is local which determines the aforementioned geographical and historical factors. ...
Surveying field measurements performed during the development and updating of land registry were based directly on measuring networks. Accuracy parameters of these networks are lower in comparison with modern measurement networks. The main reasons for the lower accuracy relate mainly to the lower precision of measurements, two orders of network and approximate techniques for determining the coordinates of the points of these networks. Currently, archival materials of the State Geodetic and Cartographic Resource are used during surveying of real estate (division, separation, modernization of land registry). The paper presents the results of experimental evaluation of the accuracy parameters of former networks. The purpose of the performed evaluation to was to analyze the possibilities of use archival materials of the State Geodetic and Cartographic Resource during surveying works related to real estate. The study was carried out on the basis of three test objects located in the Małopolskie voivodship. Points of the analyzed networks found on the ground were measured (approx. 34% of all points), and then their coordinates were determined. The representative research sample was constituted by sets of deviations Z - the length of the displacement vector of the point in the research sample in relation to its position ...
The paper, as a part of broader studies on the practical usefulness of public registers enclosing the databases on real property, in tasks related to the property appraisal, includes results of research on the scope of data collected in the Register of Prices and Values of Real Estates and its essential relationship with the needs of appraisal in comparative approach. The appraisal procedures need to recognise the features of sold properties that can have an influence on the property price variability. Evaluations of these features underlie a detailed local market analysis. Therefore, the degree of meeting the appraisal needs by the above mentioned Register data was submitted to an examination. Presented analyses are demonstrated on the examples of extracts of registers, conducted by the offices of the district authorities in Lublin Voivodeship. In the summary, a generalized picture of accomplishment of governmental tasks in the mentioned scope was presented. Needs of changes in the scope of institutionally collected real estate market data, as well as possible ways of their implementation, were also indicated. ...
The course of the boundaries of cadastral parcels is now entered into the databases of the register of land and buildings (EGiB) in numerical form using sets of coordinates of the boundary points. In the regulations on the register of land and buildings, the manner of defining a parcel boundary and its description in the cadastral databases introduces a number of new requirements, both regarding the manner of carrying out the determination of the course of parcel boundaries and documenting these proceedings, as well as the method of recording the data generated as a result of performing this procedure in the cadastral database. In recent years, determining the course of parcel boundaries pursuant to the provisions on EGiB has also become one of the most frequent surveying activities carried out both on a mass scale for the purpose of the modernization of the cadastre, as well as in individual cases concerning, for example, real estate division, cadastral database update or preparation of maps for design purposes.According to the author's opinion, the currently applicable regulations as well as the solutions used in practice are insufficient and lead to the incorrect determination and documentation of the course of parcel boundaries, and to ...
This research paper is a continuation of the previous study presenting the results of the research carried out by the Author on determining the course of boundaries of cadastral parcels and entering this data into thedatabase of the register of land and buildings. The visibly higher level of legal consciousness of the society observed since the Third Polish Republic was founded, associated with rising values of real properties (especially those intended for residential development) has increased the expectations and requirements of property owners towards the reliability of the data contained in the register of land and buildings, relating to the location and course of property boundaries. The Author of this research paper describes and analyzes the issues of determining boundaries of cadastral parcels, primarily with regard to the public register - the one which is absolutely essential for the Polish state - the register of land and buildings. The basic element of the land register survey is a computerized cadastral database. This database contains the results of proceedings and procedures for establishing the course of boundaries. Also, other public registers and individual users, including property owners and contractors of surveying works, use the data stored in this database. The Author ...
